Terms of Service

Last Updated: July 20, 2026
Version: 1

Please read these Terms carefully. They explain what The Implant Experience does, what we do not do, and the limits of what we can promise. Section 8 is especially important because it explains the limits of our alert system in plain language.

1. Who We Are and What This Is

The Implant Experience ("we," "us," or "our") is an independent patient safety platform operated by The Implant Experience LLC, a Maryland limited liability company.

These Terms govern your use of our website, applications, alerts, and related services (collectively, the "Service").

By creating an account, you agree to these Terms. If you do not agree, please do not create an account. You may still access our publicly available safety information without registering.

2. What We Are Not

The Implant Experience is not:

  • A doctor, hospital, or healthcare provider.
  • A substitute for professional medical advice.
  • A medical device manufacturer.
  • The U.S. Food and Drug Administration (FDA).
  • Affiliated with, endorsed by, or acting on behalf of any manufacturer or government agency.
  • A law firm or legal advisor.
  • An emergency service.

Using this Service does not create a doctor-patient relationship, attorney-client relationship, or any other professional relationship.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Do not rely on this Service for emergency communications.

3. Who Can Use the Service

You must be at least 18 years old to use the Service.

You agree to provide accurate information and keep it up to date. Our ability to match safety alerts depends entirely on the accuracy of the device information you provide.

You may create an account for yourself.

If you manage a device profile for another person, such as a spouse, parent, or someone under your care, you represent that you have the legal authority to do so and accept responsibility for the information you submit.

4. Your Account

You are responsible for maintaining the confidentiality of your password and for all activity occurring under your account.

If you believe your account has been compromised, please notify us immediately at our security contact email.

You may delete your account at any time. Information about how your data is handled after deletion is explained in our Privacy Policy.

5. Free Service and Implant Intel

Our free service provides access to publicly available medical device recall information, safety notices, and adverse event information.

The free service is not personalized and does not compare information against your specific implant.

Implant Intel, our paid subscription, matches publicly available safety information to the implant information you store with us and notifies you when we identify a potential match.

The underlying safety information itself is never hidden behind a paywall. What you pay for is the personalization, monitoring, and delivery of alerts.

If we become aware of safety information we believe every patient should know, we will not allow a paywall to prevent access to that information.

6. Subscriptions, Billing & Cancellation

Implant Intel is currently offered as a monthly subscription.

  • Your subscription renews automatically until cancelled.
  • Your selected payment method will be charged each billing cycle.
  • You may cancel at any time through your account settings.
  • Cancellation becomes effective at the end of the current billing period.
  • After cancellation, your account automatically returns to the free service tier.
  • You continue to have access to all publicly available safety information.

If subscription pricing changes, we will provide at least 30 days' advance notice before the new price takes effect.

7. Our Information Standards

We are committed to publishing accurate, transparent, and responsibly sourced information.

Whenever practical:

  • Every factual claim is supported by a primary source.
  • We identify and link to those sources.
  • We date our publications.
  • When information is uncertain, we clearly say so.
  • If we make a mistake, we correct it openly rather than silently editing the record.

We monitor public information sources including FDA recalls, enforcement databases, adverse event reporting systems, and peer-reviewed scientific literature.

Because these sources have limitations, we cannot guarantee that every report is complete, accurate, or immediately available. Adverse event databases often contain unverified or incomplete reports and should not be interpreted as showing how frequently a problem occurs.

8. What We Cannot Promise About Alerts

This is the most important section of these Terms.

We built this Service because important safety information does not always reach patients. While we work hard to improve that situation, we cannot guarantee that every relevant alert will reach you, arrive on time, or arrive at all.

Alerts may be affected by factors beyond our control, including:

  • Incorrect or incomplete implant information.
  • Information that has not yet been made public.
  • Differences between government and manufacturer databases.
  • Matching errors caused by inconsistent records.
  • Email delivery failures, spam filtering, network interruptions, or technical outages.

For these reasons, you should never rely on this Service as your only source of safety information.

Not receiving an alert does not mean your device has no issues.

Continue regular follow-up with your healthcare providers and maintain your own implant records.

If you receive an alert from us, do not panic and do not make changes to your medical care without consulting your physician.

Many recalls do not require removal of a device. Your healthcare provider is the only person qualified to determine what action, if any, is appropriate for your individual circumstances.

9. Your Device Information

You retain ownership of the information you provide.

You authorize us to use that information solely to operate the Service, including matching safety alerts, maintaining your account, and performing the functions described in our Privacy Policy.

We do not sell your health information or allow it to be used for advertising.

You may access, correct, export, or permanently delete your information at any time through your account.

10. Your Story, If You Share One

If you choose to send us your story, photographs, comments, or other content, you remain the owner of that content.

By submitting it, you grant The Implant Experience permission to publish, edit for clarity or length, and use it in connection with our patient safety mission.

Please understand that if your story is published, any health information you choose to share may become public.

Before publishing anything that could identify you, we will ask for your permission. You may withdraw that permission at any time before publication.

After publication, you may request that we remove your story from our website. However, we cannot remove copies that have already been shared, archived, or republished elsewhere.

Please do not submit another person's health information without their permission.

11. Acceptable Use

When using the Service, you agree that you will not:

  • Violate any applicable law.
  • Scrape, harvest, or bulk-download our content.
  • Attempt to interfere with, overload, probe, or compromise our systems.
  • Reverse engineer or attempt to copy our software.
  • Impersonate another person.
  • Misrepresent your identity to obtain information about someone else's device.
  • Use the Service to advertise, market products, or solicit clients.
  • Use the Service for legal or claims solicitation.

We reserve the right to suspend or terminate accounts that violate these Terms.

12. Our Content

Unless otherwise noted, the writing, design, software, graphics, and original content on this website are owned by The Implant Experience or its licensors.

You are welcome to:

  • Read our content.
  • Share links to our articles.
  • Quote reasonable portions with proper attribution.

You may not:

  • Republish our content in its entirety.
  • Present our work as your own.
  • Use our content commercially without written permission.

Government data that we reference remains public information and is not claimed as our intellectual property.

13. Third-Party Links

Our Service may link to FDA databases, medical research, journals, and other third-party websites.

We do not control those websites and are not responsible for their content, availability, or privacy practices.

Providing a link does not imply endorsement.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis.

We disclaim all warranties, whether express or implied, including warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Completeness
  • Timeliness
  • Continuous availability

We specifically do not guarantee that:

  • Every recall or safety issue affecting your device will be identified.
  • Every alert will reach you.
  • Alerts will always arrive before medical problems occur.

Some jurisdictions do not permit certain warranty exclusions. Those exclusions may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, The Implant Experience is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or business interruption arising from your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the greater of:

  • The total amount you paid us during the twelve (12) months before the claim; or
  • One hundred U.S. dollars (US $100).

Nothing in these Terms limits liability where such limitations are prohibited by applicable law, including liability arising from fraud, gross negligence, willful misconduct, or personal injury caused by negligence where such limits are legally unenforceable.

16. Dispute Resolution

Please read this section carefully. It affects how legal disputes are resolved.

If you have a concern, please contact us first. Many issues can be resolved quickly without formal proceedings.

If we cannot resolve a dispute informally, disputes may be resolved through binding individual arbitration, except where applicable law provides otherwise.

You agree that claims will be brought only on an individual basis and not as part of a class action or representative proceeding.

Nothing in this section prevents either party from:

  • Filing eligible claims in Small Claims Court.
  • Seeking injunctive or other relief where applicable law does not permit waiver.

You may opt out of the arbitration agreement by emailing us within 30 days after creating your account using the procedure described in these Terms.

17. Changes, Termination & General Terms

We may update these Terms from time to time.

If a material change is made, we will provide at least 30 days' advance notice by email or through the Service whenever required by law.

You may close your account at any time.

We may suspend or terminate accounts that violate these Terms or discontinue the Service with reasonable notice.

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

These Terms, together with our Privacy Policy and any applicable consents you provide, constitute the complete agreement between you and The Implant Experience.
